Sorry, could you clarify the logic here?

There are groups A and B, different by some "protected characteristic", and A gets 20% shorter sentences than B. This is discrimination.

There are groups C and D, also different by some "protected characteristic" and C gets 40% shorter sentences than D. This is not discrimination.

Why?
